Please read these Terms of Service ("Terms") carefully before using spokanewire.com or any related SpokaneWire services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About SpokaneWire
SpokaneWire is a hyperlocal news and public safety information service covering Spokane, WA. The Service is operated by Tolowa Studio LLC ("we," "our," or "us").
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
3. Accounts
Certain features (Wire+ membership, newsletters, sponsor portal) require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@spokanewire.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Scrape, crawl, or systematically download content without our prior written permission.
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Submit false, misleading, or fraudulent information, tips, or content.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Service to distribute spam, malware, or unsolicited commercial messages.
5. User-Submitted Content
You may submit tips, photos, or other content ("User Content") to SpokaneWire. By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, publish, display, and distribute that content in connection with the Service, including on our website and social media channels.
You represent that you own or have the necessary rights to submit User Content and that it does not infringe the rights of any third party. SpokaneWire reserves the right to edit, reject, or remove any User Content at its discretion.
6. Subscriptions and Payments
Wire+ and other paid membership tiers are billed on a recurring basis (monthly or annual). By subscribing, you authorize us to charge your payment method on the applicable billing cycle. All fees are in USD and are non-refundable except as required by law or as explicitly stated at the time of purchase.
Day Passes are one-time purchases and provide access for the stated duration. Subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period.
Payments are processed by Stripe. By making a purchase, you also agree to Stripe's terms.
7. Advertising
Free-tier users may see advertisements served by Google AdSense, Google Ad Manager, or other advertising partners. Wire+ and Business members enjoy an ad-free experience as described at the time of subscription.
Businesses that purchase advertising or sponsorship placements through SpokaneWire are subject to our separate Advertiser Terms, available upon request. We reserve the right to reject or remove any advertisement at our discretion.
8. Intellectual Property
All editorial content, logos, design elements, and software comprising the Service are owned by or licensed to Tolowa Studio LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
News summaries on SpokaneWire may reference or link to content published by third-party sources. We respect the intellectual property rights of others and expect users to do the same.
9. Third-Party Links and Services
The Service may contain links to third-party websites or integrate third-party services (such as Google Maps or Firebase). We are not responsible for the content, privacy practices, or terms of any third-party site or service. Accessing third-party content is at your own risk.
10. Disclaimers
SpokaneWire provides real-time public safety and news information as a convenience to the community. This information is not a substitute for official emergency communications, law enforcement instructions, or professional advice. In an emergency, always contact 911.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TOLOWA STUDIO LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tolowa Studio LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Spokane County, Washington, and you consent to personal jurisdiction in those courts.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date above. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
